Zipwire Privacy Policy

Simplicity, security and privacy are the pillars that underpin all decisions here at Zipwire, Inc. ("we", "us" or "our"). This Privacy Policy addresses our approach to protecting your privacy through our website, our downloadable applications and our services provided therethrough (collectively, the "Zipwire"). Capitalized terms used but not defined in this Privacy Policy shall have the meaning set forth in the Terms of Service Zipwire.com/TOS. By using the Websites or Apps, you consent to the data practices described in this Privacy Policy. If you do not agree with the data practices described in this Privacy Policy, you should not use the Websites or Apps.  We encourage you to review this Privacy Policy periodically as we update it from time to time. Before you read the entire document, we'd like to emphasis four key items:

  • Zipwire is a contact sharing platform. It is designed to make it easy for you to share contact information and other Personal Information (as defined below) with other Users and for us to share treat Provider Contact Information, Clinic Location Information and Clinic Directories with Premium Users.
  • We offer both free and paid services.
  • We do not share your Personal Information with advertisers or other third parties, except Premium Users in the case of providers, regardless of whether you have a free or paid account with us, although we may share aggregate information as further described below.
  • Zipwire is designed to keep your Personal Information current for those who share the same organization with you.
  • We treat Clinic Contact Cards as belonging to their sponsoring organization(s) and available to the sponsoring organization(s) and to Zipwire but not to Premium Users. We treat provider Contact Information, Clinic Location Cards and Clinic Directories as belonging to Zipwire and those data may be made available to Premium Users. Your rights with respect to Personal Information provided to us by a sponsoring organization are governed by such sponsoring organization policies.

1. How to Contact Us

2. Eligible Zipwire Users

Zipwire has services designed for individuals and others designed for organizations. Individuals may sign up for our free services or our Paid Services and organizations may only sign up for our Paid Services.

Zipwire is available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. Individuals under the age of 18 can use Zipwire only in conjunction with and under the supervision of a parent or guardian. In this case, the parent or guardian is responsible for any and all activities of such minor. If you are a parent or guardian and you discover that your child has created an unauthorized Zipwire account, please contact us at privacy@zipwire.com and we will remove the account.

3. Information We Receive

A. Information you provide to us:

Personal information. When you sign up for Zipwire, you provide us with your name, mobile number, and email address. During the registration process we give you the opportunity to provide additional Personal Information, such as additional email addresses, telephone numbers, your birthday month and year as well physical addresses, a picture of yourself, where you are employed and links to social profiles. In some cases we may ask for additional information for security reasons or to provide specific services to you. "Personal Information" means information that specifically identifies an individual (such as a name, address, telephone number, mobile number or e-mail address) or other information about that individual that is directly linked to Personal Information. Personal Information does not include "aggregate" information, which is data we collect about the use of our Website and our Services. Once you register, you can visit your profile at any time to add or remove Personal Information about yourself, but if you have already provided Personal Information to another User, please be aware that that User may have already accessed that removed Personal Information.

You may have the option to provide demographic information (such as preferred language of communication) to us; we encourage you to submit this information so we can provide you a more personalized Zipwire experience.

Our primary purpose in collecting Personal Information is to provide you with a safe and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize Zipwire to make your experience safer and easier.

As specified below, some of your Personal Information is made publicly available.

Location Information. When you share your location via Zipwire with others or create a location for a Group or other Zipwire service, we treat that like any other Personal Information you share. If we offer a service that supports this type of location sharing automatically, we will present you with an opt-in choice of whether you want to participate.

Transactional Information. We may retain the details of transactions or payments you make to or via Zipwire. When you save a payment card in your account, we collect the type (such as credit or debit) and brand of card (such as MasterCard or Visa), the card issuer, and partial card account numbers. However, we will only keep your payment source account number with your consent. For any prepaid cards we may also collect the card balance. Finally, we may receive information about the status of your card, such as if it is suspended or cancelled, from your card issuer. We may collect your transaction or payment information ourselves or through a third party online payment service.

We use this information for billing purposes and to fill your ongoing subscription. If we have trouble processing your subscription request on a periodic basis (as specified based on your subscription), we will use this information to contact you.

B. Information We Collect When You Interact With Zipwire:

Actions within Zipwire. We keep track of the actions you take using Zipwire, including without limitation creating a Group, joining a Group, sharing a zCard or updating your Personal Information. In some cases you are also taking an action when you provide information or content to us. For example, if you create a zCard and provide a new photo of yourself, in addition to storing the actual photo you uploaded, we will log the fact you updated it.

We may use this information after aggregating it with similar information from other Users in order to improve the usability and quality of our Services.

Device and Browser Information. When you access Zipwire from a computer, mobile phone or other device, we may collect information from that device about your browser type, location and IP address in order to provide you services. For mobile devices, we may also collect your device's type, phone number (if any) and the serial number of its chip. We may use your location information to determine if members of a Group are in the same physical location, among other uses.

Cookies. We use "cookies" (small pieces of data we store for an extended period of time on your computer, mobile phone or other device) to make Zipwire easier to use and to protect both you and us. We do not link cookies to Personal Information, except for your login ID (but not your password). We also use cookies to confirm that you are logged into Zipwire, and to know when you are interacting with Zipwire. You can remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use Zipwire. For example, we may not allow you to exchange zCards with another User if you have blocked cookies. We do not allow third parties access to the information stored on the cookies we use. This Privacy Policy only covers cookies used by us and not by third parties.

Clear Gifs (Web Beacons/Web Bugs). We may employ a software technology called clear gifs, also referred to as web beacons or web bugs, which helps us track what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. Unlike cookies, which are stored on a user's computer hard drive, clear gifs are embedded invisibly on websites and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to Personal Information.

We may use clear gifs in our HTML-based emails to let us know which emails recipients have opened. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. You can opt out of these emails, as set forth in this Privacy Policy. In the future we may also allow advertisers to use clear gifs to gauge the effectiveness of certain communications and marketing campaigns.

Embedded Scripts. We may use Embedded Scripts, which are programming code that collects information about your interactions with our Services, such as the links you click on. The code is temporarily downloaded onto your computer or other device from our server or a third party provider and is deactivated or deleted when you disconnect from Zipwire. In addition, we may use a variety of other technologies that collect similar information for security and fraud detection purposes.

Log Files. Like many websites, we automatically gather certain information about our traffic and store it in log files. This information includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the Website, to track users' movements around Zipwire and to gather demographic information about our user base.

We do not link this automatically collected data to Personal Information.

We use a third-party tracking service that uses log files and cookies to track non-Personal Information about visitors to Zipwire in the aggregate. This service captures usage and volume statistics to improve the usability of our Services.

C. Information We Receive From Third Parties:

Third Parties. Zipwire uses information provided by third parties just as we make information available in certain circumstances to Premium Users.

Information From Other Users. We may collect information about you from other Users as is necessary to run Zipwire. An example of how this works is found here in the FAQ portion of this Privacy Policy.

4. Information You Share With Third Parties

If you request that we share one of your zCards with a User, Group or Directory, we will share that zCard with that User, Group or Directory; please be aware that your zCard will include the Personal Information that you specified when you created that zCard, or which you may have updated since the time that you created that zCard. Once we have shared your zCard with another User, or with or Directory, any User with access to the Personal Information on your shared zCard may share your Personal Information with third parties. You agree that we are not responsible for any further sharing of your Personal Information by other Users, or by a List or a Directory. However, if you have a complaint about a User, Group or Directory's misuse of your Personal Information, please contact us at abuse@zipwire.com. While we may not be able to stop a User, Group or Directory's misuse of your Personal Information, we take seriously any misuse of the Personal Information of our Users, and we may take certain actions, up to and including banning a User, if we determine that a User has a pattern of misusing the Personal Information of our other Users.

A. Sharing Information on Zipwire. We designed Zipwire to allow you to control which Personal Information you share and which other Users you share your Personal Information with. Here are some specific things to remember:

  • You control which Personal Information you include in each of your zCards.
  • When you share a zCard with another User, a Group, List or Directory, you share the information that is on that zCard. Some Users, Groups, Lists or Directories may require certain fields before allowing you to exchange zCards or join a Group, List or Directory. You may choose not to exchange or not to join, allowing you to control what Personal Information you share with others.
  • In order to receive Personal Information of other Users in a Group, you must provide a zCard.
  • Some Groups and all Lists or Directories have administrators, who may remove Users involuntarily from time to time or may have the ability to control adding new Users to the Group, List or Directory. Your Personal Information may be shared with other members of a Group, List or Directory, as new members are added by an administrator. A n example of how this works is found here in the FAQ portion of this Privacy Policy.
  • Certain categories of Personal Information such as your name, profile photo and gender are considered publicly available, and therefore are not considered private. We will let you know if we add new categories of information that we intend to make publicly available.
  • Even after you remove information from your profile or delete your account, copies of that information may remain elsewhere to the extent it has been shared with others or it was copied or stored by other users.
  • You understand that information might be re-shared or copied by other Users.

B. Exporting Information. You (and those you make your Personal Information available to) may use tools like RSS feeds, mobile phone address books, or copy and paste functions, to capture and export information from Zipwire, including without limitation your Personal Information.

C. Links. When you click on links on Zipwire, you may leave our site and may go to sites that are not owned or controlled by us. We are not responsible for the privacy practices of other sites, and we encourage you to read their privacy statements. This Privacy Policy only applies to information collected by us through Zipwire.

5. How We Use Your Information

use the information we collect to try to provide a safe, efficient, and customized experience. Here are some of the details on how we do that:

A. To Manage Zipwire. We use the information we collect to provide Zipwire to you, to measure and improve Zipwire, and to provide you with customer support. We use the information to prevent potentially illegal activities, and to enforce our Terms of Service. For example, we may ask for your date of birth to verify that you are over 18 years old and so that we can limit your access to content and advertisements that are not age appropriate. We also use a variety of technological systems to detect and address anomalous activity and screen content to prevent abuse. These efforts may on occasion result in a temporary or permanent suspension or termination of some functions for some Users.

B. To Contact You. We will send you a welcome email and/or a welcome text to verify your email account or mobile number for each email account or mobile number you give us. We will also send you an email or text to confirm your username, provide you with a replacement password or notify you of changes to your account. We will communicate with you if you have any customer service questions using your email or other Personal Information that you provide to us, in accordance with your wishes. We may contact you with service-related announcements from time to time. We may include content you see on Zipwire in the emails we send to you.

We will use Clinic Contact Cards in the course of business to collaborate with you to verify Clinic Directory information.

You may opt out of all communications except essential updates on your account notifications page.

C. Downloadable Software. Our App and certain other downloadable applications or applets transmit data to us. If we believe our collection of and use of the information is the obvious purpose of the application, we may not make a disclosure of the information we are collecting and how we are using it, such as the fact that we receive photos when you use our photo uploader. If we do not make a disclosure, this Privacy Policy will govern our use of that information. If we believe it is not obvious that we are collecting or using such information, we will make a disclosure to you the first time you provide the information to us so that you can decide whether you want to use that feature.

6. How We Share Information

Zipwire is about connecting with others while allowing you to control what is shared. We share your information with third parties when we believe the sharing is permitted by you, reasonably necessary to offer our services, or when legally required to do so. For example:

A. When You Make a Payment. When you enter into transactions with others or make payments on Zipwire, we will only share transaction information with those third parties necessary to complete the transaction and will require those third parties to agree to respect the privacy of your information.

B. When You Invite a Friend to Join. When you ask us to invite a friend to join Zipwire, we will send your friend a message on your behalf using your name. We may also send up to two reminders to them in your name. If your friend does not want us to keep their information, we will remove it at their request if your friend emails us at privacy@zipwire.com.

C. To Help Improve or Promote Zipwire. We may share aggregate information with third parties to help improve or promote our Services. If we share aggregate information, we remove information that can identify an individual user.

D. To Provide You with Services. We may provide information to service providers that help us bring you the services we offer. For example, we may use third parties to help host our website, send out email updates about Zipwire, remove repetitive information from our user lists, or process payments. These service providers may have access to your Personal Information for use for a limited time, but when this occurs we implement reasonable contractual and technical protections to limit use of that Personal Information to help us provide the service.

E. Legal Requests and Operation of Law. We reserve the right to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights; to comply with a judicial proceeding, court order, or legal process served on us or our services; or in connection with an actual or proposed corporate transaction or insolvency proceeding involving all or part of the business or asset to which the information pertains. We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent harm, or to protect ourselves and you from people violating our Terms of Service. This may include sharing information with other companies, lawyers, courts or other government entities.

F. Surveys, Contests and Promotions. We may provide you the opportunity to participate in surveys, contests or promotions through Zipwire. If you participate, we will request certain Personal Information from you. The requested information typically includes contact information (such as name and shipping address) and demographic information.

We use this information to notify contest winners and award prizes, to monitor website traffic, or to personalize Zipwire (in the case of anonymous information collected in surveys) and to send participants an email newsletter.

We may use a third party service provider to conduct these surveys, contests or promotions on Zipwire. If we use a third party to do so, a link to the third party's privacy policy will appear in the window that opens for the survey, contest or promotion, and you are now subject to that third party's privacy policy. If you have any questions or concerns regarding how such third parties use your information, please consult the applicable third party's privacy policy. You agree that we will not be responsible or liable for any loss or damage incurred in connection with our affiliation with such third parties, their activities, and the sharing of your information with such third parties.

If you do not see a link to a privacy policy in a survey, contest or promotion window that pops up automatically or opens when you click on a link, or if you fill out a survey, contest or promotion form on our website that appears on a main page without a separate privacy policy link, our Privacy Policy applies.

7. How You Can View, Change, or Remove Information

A. Viewing and Editing Your Profile. You may change or delete your profile information at any time by going to your profile page and clicking "Edit My Account." Information will be updated promptly. While you cannot delete your name email address or mobile phone number, you can create zCards that do not share email address and/or your mobile number. You cannot create zCards that do not include your name.

B. Deactivating or Deleting Your Account. If you want to stop using your Zipwire account, you may deactivate it or delete it. When you deactivate an account, no User will be able use the account, but it will not be deleted. We save your profile information (groups, photos, contacts and other information) in case you later decide to reactivate your account. Users deactivate their accounts for temporary reasons and in doing so are asking us to maintain their information until they return to Zipwire. You will still have the ability to reactivate your account and restore your profile in its entirety. When you delete an account, it is permanently deleted. You should only delete your account if you are certain you never want to reactivate it. You may deactivate your account by sending a request to privacy@zipwire.com. Please note that once you have deleted your account, you will no longer be a member of any Group that you joined prior to the deletion, even if you later rejoin Zipwire, unless you are invited to rejoin Groups and only in cases where those Groups have administrators. If your account is in part a sponsored account, only the sponsoring organization may delete or modify the sponsored portion of such account.

C. Limitations on removal. Even after you remove information from your profile or delete your account, copies of that information may remain viewable elsewhere to the extent it has been shared with others, it was otherwise distributed by you, or it was copied or stored by other Users. Additionally, we may retain certain information to prevent identity theft and other misconduct even if deletion has been requested.

D. Backup Copies. Deleted information may persist in backup copies for up to 90 days, but will not be available to other Users.

E. Non-User Contact Information. If a User provides your email address to us, you are not a Zipwire User and you want us to delete your address, you can do so by emailing us at privacy@zipwire.com. However, that request will only apply to addresses we have at the time of the request and not to any addresses that Users provide to us later.

8. How We Protect Information

A. Steps We Take to Keep Your Information Secure. We keep your Personal Information on a secured server behind a firewall. When you enter sensitive information (such as credit card numbers and passwords), we encrypt that information using secure socket layer technology (SSL). We also use automated and other measures to enhance security. We may limit use of Zipwire in response to possible signs of abuse and may suspend or disable accounts for violations of our Terms of Service www.zipwire.com/terms.

B. Risks Inherent in Sharing Information. Although we allow you to set privacy options that limit access to your Personal Information, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom you share your information. We cannot guarantee that only authorized persons will view your information. We cannot ensure that information you share on Zipwire will not become publicly available. We are not responsible for third party circumvention of any privacy settings or security measures on Zipwire. You can reduce these risks by using common sense security practices such as choosing a strong password, using different passwords for different services, and using up to date antivirus software.

C. Report Violations. You should report any security violations to us by email to privacy@zipwire.com.

9. Other Terms

A. Changes. If we decide to change our Privacy Policy, we will post changes to this Privacy Policy and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

We reserve the right to modify this Privacy Policy at any time, and such change will apply with respect to information you provide or your activity on the Website after the change in policy, so please review it frequently. If we make changes that materially affect our uses or disclosures of Personal Information that we have previously collected, we will contact you here, by email, or by means of a notice on our home page to obtain your consent to have the changes to our Privacy Policy apply retroactively.

B. Consent to Collection and Processing in the United States. By using Zipwire, you consent to having your personal data transferred to and processed in the United States.

10. Frequently Asked Questions and Examples

  • Updating contact information: Updating contact information: If you shared a zCard with "Bill" that contained your first name, last name and personal email address, "Bill" would receive an update each time you replaced or updated your email address in the personal email address field in your Zipwire profile. If you were to change your mobile phone number, "Bill" would not receive that update because you did not give him that contact information when you exchanged zCards.
  • Information from other Users: An alumni association may join Zipwire as a paid user hoping to create a trusted and dynamic connection to you via Zipwire. The alumni association may provide Zipwire with your last known email address, physical address or other details necessary for us to reach you and for them to associate your updated information with their systems.
  • Administrators sharing lists: You may join a soccer team through a local league where the league uses Zipwire to create and distribute team Lists. The soccer club may publish the contact details you provided them to everyone in the club and the contact information for all the other players to you. In order to comply with Zipwire's policies the league must have told you when you registered that it would share your details and which details it would share and with whom. You must be given the opportunity to opt in or opt out from such an arrangement.
